The
Fiancée Visa (K-1)
This
visa is available for those persons living outside the
U.S. who are engaged to marry a U.S. citizen ("USC").
The criteria for this visa are that the person seeking
entry be the fiancée of a USC, and that the person seeking
entry seeks to enter the U.S. solely to conclude a valid
marriage with the petitioning USC within 90 days of
their entry.
To
apply for this visa, the USC petitioner must file the
appropriate petition with I.N.S. Service Center having
jurisdiction over the area where the petitioner lives.
Included in the application must be proof that:

there is a bona
fide intention to marry;

the USC and the fiancée
are legally able to marry;
-
the USC and the fiancée
are willing to conclude their marriage within 90
days of the fiancée's entry; and
-
the USC and the fiancée
have met in person within two years of the filing
of the petition.
Watch
Out! If the USC and the fiancée
do not get married within 90 days, the fiancée will
have to return to their home country to have their status
adjusted to that of lawful permanent resident. This
is NOT a flexible requirement.
